Delay Expert
- We have provided expert witnessing services in a number of complex dispute matters that involved delays, extension of time, levy of liquidated damages and claims for additional compensation for delays & disruptions.
- We conduct programme based delay analysis in Primavera or MS Project software (if factual data support such analysis) and provide expert opinion based on industry standard practices such as Delay & Disruption Protocol published by the Society of Construction Law (SCL Protocol), United Kingdom and AACE International Recommended Practice.
Residential building projects
- Provided expert witness services involving delay & quantum in an arbitration of construction dispute involving main contractor and a specialist subcontractor in a public housing project. This was a major upgrading programme involving three estates comprising of 13 towers. The dispute in arbitration was for the costs liability for early termination of the subcontractor.
- Provided expert witness services involving delay & quantum in an arbitration of construction dispute involving main contractor and the owner of high-end landed house construction. Delay analysis using ‘collapsed as-built’ method was used to determine contractor’s liability, but for the delays caused by the architect and the owner.
Commercial building projects
- Provided expert witness services involving quantum dispute in a litigation matter between main contractor and a specialist subcontractor in ascertaining early termination costs including assessment of work done in supply and installation of aluminium façade and glazing in a high-rise office building project.
- Provided expert witness services involving quantum & delay dispute in a litigation matter between main contractor and specialist subcontractor in ascertaining responsibility for the delays, liquidated damages and additional costs due to delays and changes in piling, kingpost installation and diaphragm wall works in a top-down method of construction of a high-rise commercial building.
Hospitality Sector
- Provided expert evidence to the Dispute Adjudication Board (DAB) on delay issues under a FIDIC EPC/Turnkey construction contract for the refurbishment of a 5-star hotel in order to consider the quantum of responsibility for liquidated damages and costs of construction delays of the Main Contractor towards the Developer in West Africa
Thermal Power Project
- Provided expert evidence in an ad hoc arbitration between civil contractor and State owned power generation company in a Balance of Plant works package involving construction disputes concerning milestone delays including input delays from the plant contractors.
